Data Demonstrates an Uptick in SEC Enforcement Actions in the Second Half of 2018

According to a study conducted by the New York University Pollack Center for Law & Business and Cornerstone Research, there has been an uptick in enforcement actions taken by the SEC against public companies and subsidiaries in the second half of this year.
More specifically, according to the study, the SEC has filed 55 new actions against public companies and subsidiaries in the second half of this year. To put this number in perspective, there were only 65 filings in total for the entire year of 2017.
In addition, monetary settlements have increased by 87% from the previous year. Moreover, public company and subsidiary enforcement actions totaled more than $2.4 billion in monetary settlements in 2018, which was more than the total in any fiscal year since at least 2010.
According to the report, the most common enforcement action taken by the SEC against public companies and subsidiaries in 2018 were administrative proceedings. In total 85% of all enforcement actions taken by the SEC against public companies and subsidiaries in 2018 were brought as administrative proceedings. However, 55% of actions taken against non-public companies or subsidiaries were filed as civil actions.
