The Commodity Futures Trading Commission (CFTC) has issued an Advanced Notice of Proposed Rulemaking (ANPRM) seeking public comment on a potential regulatory framework for retail commodity transactions involving crypto assets, which the agency calls "CTXs." According to the CFTC's press release, the initiative focuses on Section 2(c)(2)(D) of the Commodity Exchange Act (CEA) and aims to establish rules tailored to these transactions.
CFTC Chairman Michael S. Selig described the proposal as a step toward strengthening consumer protections and providing greater regulatory clarity in crypto asset markets. He said the agency intends to use its existing statutory authority to develop a federal regulatory framework and establish rules that prevent fraud rather than rely solely on enforcement after misconduct occurs.
According to the CFTC's press release, the ANPRM seeks feedback on how the CFTC can prevent abusive practices in crypto markets, provide industry-specific guidance on compliance requirements, and establish a new category of designated contract market registration for crypto asset markets. The proposed category would specifically address CTXs.
According to the CFTC, the agency will use public comments to evaluate potential future regulatory action under Section 2(c)(2)(D) of the CEA. The notice begins the agency's process of considering rules tailored to retail crypto asset transactions.
